Kcalmo Terms of Use

This is a translation of the Dutch terms of use. If the two differ, the Dutch version applies.

1. Who we are

Kcalmo is provided by Luuk de Vries Reilingh, who can be reached at info@kcalmo.com.

2. What Kcalmo is — and what it is not

Kcalmo helps you keep track of what you eat, with an estimate of calories and macronutrients.

Kcalmo is not a medical device and does not give medical advice. The numbers are estimates: they come from a food database and from formulas designed for an average person. Your actual needs may differ by 10 to 15 percent. Do not use the app as a replacement for a doctor or dietitian, and consult one if you are in doubt.

For some people, counting calories is not helpful. If you notice that tracking occupies you more than it gives you, stop. Under About in the app there is a link to support.

3. Your account

An account is optional; the app works without one. If you create one, you sign in with a code sent by email — there is no password.

You are responsible for access to your email. Whoever can open your mailbox can open your account.

You can delete your account in the app at any time. Deletion is permanent.

The product data comes from two sources:

This data is supplied by third parties and may contain errors. If you find one, you can correct the product in the app for yourself.

6. Free use and subscription

What is free. Searching the food database, scanning barcodes, logging by hand, your daily overview with totals and macros, creating your own products and the goal calculator. With no time limit and no monthly maximum.

What the subscription is for. Logging what you ate by voice, the nutrition label scanner, the widgets, the daily total on your Lock Screen, Siri, the Progress tab and the Health connection.

Fair use. Voice logging is meant for what you eat yourself. Every sentence you say is processed by a service that costs us money per use, so there is a generous weekly limit. With normal use, even if you say every meal and every snack, you will not reach it. If you do, you cannot use voice logging until Monday. Searching, scanning and logging by hand keep working.

There are no advertisements.

What you sign up for. A yearly or monthly subscription that renews automatically. The price and the period are shown on the subscription screen in the app and in the App Store; that is also where you can see whether a free trial applies and how long it lasts. Prices may differ per period and we may change them; a new price only applies after Apple has notified you, and never to a period that has already been paid for.

How you pay. Payment is charged to your Apple ID. The amount is charged when you confirm the purchase, and then at the start of every new period.

Automatic renewal. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. If you start a free trial and don't cancel, the subscription continues after the trial — that is how Apple handles it and we cannot change that.

A reminder before the trial ends. If you start a free trial and allow notifications, we send you a notification two days before the end, so you can decide whether to continue.

Cancelling. In the app via Settings → Subscription → Manage in the App Store, or directly in your Apple ID settings. Cancellation takes effect from the next period; a period already paid for runs until its end. We cannot end your subscription ourselves and cannot issue refunds — that is handled exclusively by Apple.

What keeps working without a subscription. Signing out, downloading all your data, and deleting your account. Always, even if you never paid or have stopped. Your data is yours and is never behind the paywall.

Restoring an earlier purchase. If you reinstall the app or move to another device, use Restore purchases on the subscription screen.

7. Liability

We do our best to keep the app working and the data correct, but we cannot guarantee that the app is always available or that every value is correct. We are not liable for damage arising from the use of the app, except in the case of intent or gross negligence, and except where the law provides otherwise — as a consumer you keep your mandatory statutory rights.

8. Changes

We may change these terms. If a change is material, we will announce it in the app before it takes effect.

9. Governing law

These terms are governed by Dutch law.
